Attorney Lankau now a certified mediator (FH) as well

A CONSULEGIS member law firm, Lankau & Collegen in Darmstadt, Germany, has informed us that Ingo-Endrik Lankau, a specialist for administrative law and public notary, has now been granted the academic title of certified mediator - the first lawyer in the state of Hessen to receive this degree. Lankau, 59, completed a four-semester continuing-education course at the Evangelische Fachhochschule Ludwigshafen (a protestant university at Ludwigshafen) and earned an overall "good" grade in fall 2004. The course focused on the theory and legal practice of mediation, i.e., out-of-court settlement of conflicts, as well as methods and fields of application.

 

The Ludwigshafen university is the only school in Germany to confer this diploma based on a federally approved examination. Lankau discussed the opportunities and limits of mediation within the administrative process in his degree dissertation. In addition to the roughly 500 hours of study involved, the lawyer had to document 20 of his own cases involving mediation including one "live" case. Lankau sees valuable opportunities to help squabbling parties resolve their conflicts with the help of out-of-court mediated settlement procedures. As opposed to a court verdict's "all-or-nothing" approach, he holds the "win-win" solution of mediation to be more objective in many cases. "If both parties rediscover their respective interests in a self-formulated solution through the help of a mediator," Lankau says, "then this solution also becomes absolutely acceptable."

 

However, the premise for mediation is a voluntary give-and-take attitude on both sides. Lankau not only foresees the emphasis of his activity as a certified mediator in the sectors of administrative law, where the trained and experienced former administrative official's legal practice has focused (former board member of Hessen's alliance of cities and towns as well as mayor of the district town of Groß-Gerau). He also offers mediation in the sectors of labor, economics, and organizations, the points of emphasis during his university training in mediation. According to Lankau, mediation can be conducted within any field of conflict in which the conflicting parties want to work out a common solution to their conflict - particularly in the sectors of marriage and the family, school, business and working life, as well as all aspects of politics and administration.
