Attorneys General Support New Food Product Labeling Program
On July 29, 2010, the Ohio Attorney General joined 11 other state attorneys general in support of the U.S. Food and Drug Administration’s proposal to make food labels more meaningful to consumers. Richard Cordray, Ohio’s Attorney General stated, “As Ohio consumers strive to save money, it shouldn’t cost them their health.”
Ohio has its own labeling laws that prohibit selling or offering to sell any food, drug, device or cosmetic that is misbranded and prohibit the “dissemination of any false advertisement.” Cordray has signaled the request for increased penalties in the Federal Bill and enforcement of all labeling and misbranding laws.

USA, new Proposed Whistleblower Provisions to FCPA

Senate Bill 3217, the Restoring American Financial Stability Act of 2010, seeks to pay a bounty between 10 and 30% of any monetary sanction imposed to whistleblowers who voluntarily provide “original information”
to the Securities and Exchange Commission (SEC).

EUROPEAN COURT DECISION, May 6, 2010, ECJ, Case C-145/08

Referring to Directive 92/50/EEC but also applicable to Directive 2004/17/EEC, the European Court of Justice decided on 6th May 2010 that the different aspects of a mixed contract constitutes for the main proceedings an indivisible whole, of which the aspect relating to the transfer of shares constituted the main object. It furthermore came to the conclusion that the transfer of shares to a tenderer in the context of a privatisation of a public undertaking did not fall within the scope of the directives on public contracts.

Successful Seminar on latest law developments in Europe
International Consulegis Symposium 2009 in Mölln, Germany on 27/28 March 2009 (in German language),
REPORT
On Friday and Saturday 27 – 28 March 2009 eleven law firms presented by 17 participants from five countries (Germany, Austria, France, Great Britain, Switzerland) met in Mölln, a small town close to Hamburg, Germany. The conference focused on topics in the areas of European company law, European private international law, developments in the case law of the European court of justice, international insurance law, compliance, insolvency and restructuring. For example, Kay Gaetjens (Weissberg, Gaetjens, Ziegenfeuter, Paris) gave a presentation on the draft law of the European private company. Boris Steinmair (Kraft & Winternitz, Vienna) and Katharina Gebauer (BRĂDERMANN & JAHN, Hamburg) introduced the new European private international law which has come partly into force in January 2009 (ROM II) and will partly come into force on 17 December 2009 (ROM I).
The final session on Friday, presented by Dr. Roland Ermini, concentrated on the developments within Consulegis. On Saturday, the forum concentrated on the impact of the world financial crisis on legal business and came up with a number of creative and reasonable ways of charging for legal work.

The symposium was as successful as the symposium in 2008. For all those of us who spend a lot of their time working in German, this international conference was a very useful tool to bring everybody up to speed on the latest developments in the law. We thank Eckart Brödermann and his colleagues from BRĂDERMANN & JAHN for organizing this excellent event.

German law firms BRĂDERMANN & JAHN and Möllenhoff join forces by reciprocal counsel-ship
With effect as of 1 January 2009, the German law firms Brödermann & Jahn Rechtsanwaltsgesellschaft mbH (Hamburg) and Möllenhoff (MĂŒnster) have entered into a cooperation agreement whereby Dr. Ulrich Möllenhoff will become Counsel to Brödermann & Jahn and Dr. Eckart Brödermann will become counsel to the Möllenhoff law firm. In particular, the firms intend to create in Hamburg a unit with strong competences in the areas of export control and customs law. Hamburg is one of the leading European international trade centres. It has one of the biggest international ports (number two in Europe and number eight in the world). As a result, Brödermann & Jahn has developed over the years a practice in this area which now shall be boosted by the competence of Dr. Ulrich Möllenhoff, who since years, specialises solely on customs, excise and export control (foreign trade law). He will be able to rely on the team of Brödermann & Jahn in dedicated matters. The cooperation is the result of a close working relationship of the two firms including advice on the export control law in a five billion Euro transaction
